[Saorín describes the royal decree law that regulates the figure of the vulnerable consumer as "great progress" (26/01/2021)

The Councilor for Consumption of the Cieza City Council, Francisco Saorín, highlights that, with the rule promoted by Minister Alberto Garzón, companies will have to provide the necessary support to consumers so that they can correctly understand the content of the contracts they sign. Last Tuesday, January 19, the Council of Ministers approved the royal decree-law for the protection of consumers and users against situations of social and economic vulnerability, at the initiative of the Ministry of Consumption led by Alberto Garzón and which regulates the figure of the consumer vulnerable and "reinforces" the protection of the most vulnerable people in consumer relationships. In a press release, the Councilor for Consumption of the Cieza city council, Francisco Saorín, stressed that the royal decree "extends the guarantees" of consumer rights, "especially" of people in situations of "greater vulnerability and defenselessness "against companies when establishing" any type of contract ", among which are minors, elderly people, with low levels of digitization, with disabilities or with difficulties in accessing information. According to Saorín, these are citizens "particularly exposed" to abuse, fraud, scams and deceit through marketing or information techniques, for which the Government develops "special" support or assistance measures to ensure that they make appropriate consumer decisions.

with your interests. The royal decree-law is covered by article 51.1 of the Spanish Constitution and is "integrated", in the opinion of the Councilor for Consumer Affairs, in EU community policies under the protection of the New Consumer Agenda by the European Commission , which designs European consumer policies for the period 2020-2025 with a "very broad notion" of consumer rights and, "especially", of the most vulnerable groups and is implemented for the first time in Spanish regulations through of this "specific" figure. In turn, it is about providing "adequate legal support" to public administrations so that they "promote" policies in defense of consumers and "particularly, with additional guarantees" of vulnerable consumers, a "broad" concept, which, according to Saorín, "expands beyond" the vulnerability linked to socioeconomic factors. Likewise, Saorín explained that it is a tool called to be "very important" in the future, but that, in his opinion, "has a crucial importance from the present" and will allow administrations to "correct" situations of "defenselessness ", which have been" aggravated "in the last year by social isolation and restrictions on mobility due to Covid-19. In the mayor's opinion, the Government creates, therefore, a legal umbrella that guarantees that consumer relations are carried out in "more egalitarian, accessible, transparent and safer environments" and establishes a mandate for public administrations to, in the As far as possible, "orient" Consumer policies towards these most vulnerable groups. Thus, from now on, companies have the responsibility of providing additional support in the information they provide for decision-making, with the aim that vulnerable consumers do not see their accessibility limited and for the first time it is included in the expressly the obligation, on the part of companies, to provide the necessary support to vulnerable consumers so that they can correctly understand the content of the contracts they sign. Finally, the Councilor for Consumption has indicated that "no one throughout his life is exempt from suffering situations of vulnerability" before companies and has warned that consumer relations "more transparent, democratic and egalitarian benefit the whole of society , whether consumer or business.
